Refunds
If the product is not to your liking and/or is damaged during transport, we at PASAM take responsibility for taking care of the incident. Having seen and considered the goods for sale, a return is not possible, however, a refund or shipment of the same product previously purchased is possible.
GENERAL CONDITIONS
These general conditions (the “General Conditions”) are governed by Legislative Decree 6 September 2005 n. 206 (“Consumer Code”) containing the provisions for the protection of consumers and in particular articles 50 to 68 relating to distance selling.
The General Conditions apply to purchase orders for products issued online on this website (www.spicchiu.com).
By ticking the “I have read and accept the terms and conditions of the website” box that appears during the purchase procedure, the buyer accepts all the contractual conditions set out below. In the absence of express acceptance of the General Conditions, it will not be possible to complete the online purchase procedure.
PASAM reserves the right to modify the General Conditions at any time without notice. However, the changes will not be valid for purchase orders that were sent before the changes were published on the Site.

By accepting the General Conditions and therefore by issuing the purchase order, the buyer expresses consent for all communications to be sent and received via email. The cost for using the communication technique depends on the tariff applied by the internet service provider.
The buyer will be responsible for the correctness of the email address and all information entered when placing the order or opening his account.

ORDER ISSUANCE AND PURCHASE CONDITIONS
The buyer will be able to purchase the Products by accessing the “Shop” section of the Site. The purchase order will be automatically issued at the end of the order issuing procedure in the “Shop” section. Only the Products present in the online catalog of the Site in the “Shop” section at the time the order is issued can be purchased.
The correct receipt of the order will be confirmed by PASAM via email communication sent to the email address provided by the buyer. The message confirms the essential characteristics of the purchased good, the price of the purchased product including taxes and additional duties, delivery costs, payment and delivery methods. The confirmation message will contain the order identification number to be used in any subsequent communication with PASAM.
PASAM will ship the Products ordered from the online catalog of the Site to the “Shop” section on the following Monday after receipt of the order and subsequent accreditation.
In the event of failure to execute the order due to unavailability – even temporary – of the Products, PASAM, within thirty days of receipt of the order, will inform the buyer by email to the email address and will consequently arrange for re-credit any sums paid.
There is no minimum amount to place the order.
PASAM will only take charge of orders for which the correct
payment procedure within the terms set out in the “Shop” section of the site. Otherwise PASAM will deem the order null and void by communicating the dispute to the buyer.
BILLING
There is no obligation for PASAM to issue an invoice following sales via e-commerce. Purchases made through the “Shop” section of the website will therefore be accompanied by a delivery note. However, it is possible to request the issuance of an invoice together with the execution of the purchase in the “Shop” section.
No changes to the invoice will be possible after it has been issued.
DELIVERY
The delivery times of the goods to the Carrier will depend on the payment method chosen by the Customer. After the payment of the order, the goods will be delivered to the Carrier and delivered to the Customer within an average indicative time of 2/4 working days following the date of the accounting of the payment chosen by the Customer. In no case can PASAM be held responsible for delayed or failed delivery attributable to the Carriers or to force majeure or unforeseeable circumstances.
If delivery is not possible within 30 working days, then it will be possible to cancel the order. In this case PASAM ensures the refund of the amount spent for the purchase of the products within 30 working days of canceling the order.
PRICES AND DELIVERY COSTS
All prices of the Products contained in the online catalog of the “Shop” section are expressed in Euros. All prices must be considered inclusive of VAT. The Products are sold at the list prices in force at the time the order is issued.
PASAM reserves the right to vary shipping costs upon prior telephone notification for deliveries to particularly logistically difficult locations which require the implementation of special porterage by the courier.
The buyer undertakes to reimburse PASAM for any additional expenses that it may have incurred for shipments or handling caused by the buyer’s failure to comply with the agreements made for the date, time and place of delivery.

Payment for the Products can be made exclusively via PayPal, credit card or bank transfer.

PASAM allows the buyer to make online payments in complete security thanks to an automatic encryption system of the information entered and the assistance of an external provider.
The credit card data will be provided by the buyer during the order issuing procedure.
RIGHT OF WITHDRAWAL, NON-COMPLIANT PRODUCTS
The Customer cannot exercise the right of withdrawal in the case of goods which by their nature cannot be returned or risk deteriorating or altering rapidly (e.g. fresh food products, fruit, vegetables). Among them, some types of food goods are also fully included (art. 47, paragraph 1, letter l), cod. cons. and art. 59 Legislative Decree 21/2014), and specifically: those that are “likely to deteriorate or expire rapidly”.
Section: Non-compliant products 8. Warranty and Defects of conformity for non-food products. In the event of lack of conformity of Products sold by PASAM, the Customer must immediately contact PASAM by telephone or by sending an e-mail to: info@spicchiu.com. The legal guarantees provided for by articles 129, 130 and 132 of the Consumer Code apply to the sale of products. The Customer has the right, at his choice and provided that the type of Product allows it, to restore, without charge, the conformity of the Product through repair or replacement, or to an adequate reduction in the price or to the termination of the contract. The Customer loses these rights if he does not report the lack of conformity to PASAM within the following day of receipt of the products.
MAJOR FORCE
PASAM will not be held responsible for failures or delays in the execution of the order in the event that such failures or delays are caused by impediments such as work interruptions,
trade union unrest, suspension of transport and any other cause that may constitute an impediment due to force majeure or unforeseeable circumstances.
APPLICABLE LAW
The General Conditions are governed by Italian law.
For any dispute relating to the General Conditions, the court of residence of the buyer will be competent, in the event that the buyer is a consumer. In all other cases, the territorial jurisdiction will be exclusively that of Syracuse (SR).
Any reference to the PASAM brand/domain must be understood as made to the PASAM Company with headquarters in Via Elorina, Siracusa (SR), VAT number: 00811050897
SHIPPING TERMS
PASAM will deliver, on behalf of the Customer, the products ordered online in collaboration with the following goods transport companies: GLS and BRT.
The delivery times of the goods to the Carrier will depend on the payment method chosen by the Customer. After payment of the order, the goods will be delivered to the Transporter and delivered to the Customer within an indicative average time of 2/4 working days following the date of accounting of the payment chosen by the Customer. Due to force majeure, delivery times may be extended and in this case, the Customer will be promptly notified.
Deliveries will be made on Monday and Tuesday during normal working hours.
No deliveries are scheduled on Saturdays, Sundays and public holidays.
All deliveries are considered to be made on the ground floor.
Under no circumstances can PASAM be held responsible for delayed or failed deliveries attributable to the Transporters or due to force majeure or unforeseeable circumstances.
PASAM does not assume any responsibility for any disservices attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that prevent the contract from being executed in whole or in part within the agreed times.
Upon receipt of the goods, the Customer is required to check:
that the number of packages delivered corresponds to what is indicated on the invoice;
that the packaging is intact, not damaged even in the slightest, nor wet or otherwise altered, even in the closing materials (adhesive tape or plastic or metal straps);
that the external packaging of the product is not visibly damaged;
that the products contained do not have obvious dents. Any damage or mismatch in the number of packages or indications must be immediately reported to the courier carrying out the delivery, adding the words: “withdrawal with reservation due to lack and/or damage of XXX packages” specifying the reason for the reservation , for example: lack of 1 package, crushed, punctured, wet cartons, without straps, etc., on the appropriate DDT (Transport Document) and confirmed, within 2 days, by sending an e-mail to the following address: info@spicchiu.com
In any case, the goods must be checked immediately upon receipt to ascertain the presence of any damage and/or hidden anomalies, i.e. not directly visible with the checks indicated in point 10.8. These must be reported promptly to the following address: info@spicchiu.com
Any report beyond the aforementioned deadlines and/or using methods different from those indicated above will not be taken into consideration. For each declaration, the Customer assumes full responsibility for what is declared. Once the Courier’s document has been signed, the Customer will not be able to make any objection to the delivered goods and therefore, it will no longer be possible to request an insurance refund or replacement of the product due to transport damage.
Shipping costs for the entire national territory (ITALY) are calculated during checkout on the site. Deliveries to particularly logistically difficult locations which require the implementation of special porterage by the courier are excluded from these costs. In such cases PASAM reserves the right to request an extra payment from the customer via telephone notification.
The goods travel insured for the amount shown on the invoice and via the no. shipping, the Customer will be able to connect to the website of the appointed Transporter and follow the shipment in real time. The shipping number and the name of the appointed transporter must be requested by the Customer at the e-mail address: info@spicchiu.com
